1. Who we are
Executive Headshot Pro (the "Service") is operated by Torque AI, Inc.("Torque AI", "we", "us"). By using the Service, you are entering into a contract with Torque AI.
2. Acceptance
By creating an account, purchasing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.
3. The Service
Executive Headshot Pro is an AI-powered portrait studio that generates professional-style headshots from photos you upload. Outputs are produced by generative AI models and may vary in quality and likeness.
4. Acceptable use
You must not:
- Use the Service unlawfully, for fraud, spam, or to harass others.
- Upload photos of a person without their consent, or photos of minors without parental consent.
- Use the Service to create deepfakes, impersonate others, generate sexual content, hateful content, or other prohibited material.
- Infringe anyone's intellectual property, privacy, or other rights.
- Probe, scan, scrape, or interfere with the security or integrity of the Service, including introducing malware.
- Reverse engineer, resell, or redistribute the Service.
5. Your content and outputs
You retain ownership of the photos you upload. You grant Torque AI a limited, worldwide licence to host, process, and transmit your content solely to provide the Service. Subject to your compliance with these Terms, you own the AI portraits generated for you and may use them for personal or commercial purposes.
You are responsible for your prompts and uploads, for verifying that you have the rights to any input content, and for how you use the outputs. Generative AI outputs may be inaccurate; you must review them before relying on them. We may filter, refuse, or remove outputs that violate these Terms, and we may suspend accounts engaged in repeated infringement.
6. Intellectual property
Torque AI owns the Service, including its software, models, branding, and documentation. These Terms do not transfer any of those rights to you. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have purchased.
7. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment terms, billing, taxes, currency, cancellations, and refunds are governed by Paddle's Buyer Terms and our Refund Policy. Prices and plan quotas are shown on our pricing page and apply at the time of purchase.
8. Account and credentials
You must provide accurate information and keep it up to date. You are responsible for safeguarding your account credentials and for activity under your account.
9. Service availability
We work hard to keep the Service available but do not guarantee uninterrupted or error-free performance. We may modify, suspend, or discontinue features at any time.
10. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your account data after a reasonable export window.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to us (via Paddle) in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (such as fraud, death, or personal injury caused by negligence).
13. Indemnity
You will indemnify and hold Torque AI harmless from claims arising out of your uploaded content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless a mandatory consumer law of your residence requires otherwise.
15. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the changes take effect constitutes acceptance.
